While hospitals are not licensed in Ohio, the maternity unit and newborn care nursery within a hospital are licensed by the Ohio Department of Health (ODH) under the provisions of Chapter 3711 of the Ohio Revised Code (ORC). Maternity units, newborn care nurseries, and maternity homes are subject to this statute and the rules that set the standards for operation are found at Chapter 3701-7 of the Ohio Administrative Code (OAC). A maternity unit is any hospital unit or place where women are received and care is provided during all or part of the maternity cycle, and/or where newborn infants are received and care is provided.


A newborn care nursery may either be a part of a hospital maternity unit or a distinct portion of a hospital not offering labor and delivery services to women in which inpatient care is provided to infants and includes "neonatal intensive care units" (NICU) where intensive care is provided to infants.
